Die Berufung der Beklagten gegen das am 3. August 1998 verkündete Urteil des 4. Senats (Juristischer Beschwerdesenat und Nichtigkeitssenat) des Bundespatentgerichts wird auf Kosten der Beklagten zurückgewiesen.

Die Beklagte ist eingetragene Inhaberin des unter anderem für die Bundesrepublik Deutschland erteilten europäischen Patents 0 404 537 (Streitpatent), das auf einer Anmeldung vom 27. Dezember 1990 beruht, mit der eine Priorität vom 23. Juni 1989 geltend gemacht worden ist. Das Streitpatent in der Verfahrenssprache Englisch ist mit folgendem Patentanspruch 1 erteilt worden:
